Service Agreement

The Parties agree that the Customer has contracted with Beechmount Pool Services (herinafter BPS) to perform pool and/or spa maintenance at the address specified above. The Parties agree that this is a seasonal Service Contract and Customer agrees to pay BPS on pre-arranged installment dates, as well as for monthly chemical/accessory/service provided for the Customer. The Parties agree that in the event Customer fails to pay as required by this Agreement, the contract may be terminated and Customer shall be required to pay any and all unpaid invoices. Failure to do so may result in legal action.

1. Service Frequency and Fees: BPS will provide pool service on a bi-weekly, once-weekly or twice-weekly schedule at the Customer's address stated above based on Life of Leisure package selection. Customer agrees to pay for the package (opening, Spring clean-up, maintenance, and closing) as per the regular payment schedule (1. time of registration; 2. June 1st 3. July 15th; 4. September 1st). The Customer also agrees to pay for all chemicals, accessories and/or service provided outside of the package installments on a regular, monthly basis.
   
   The Parties agree that circumstances can arise that affect or prevent BPS from performing pool and/or spa maintenance such as the weather, an illness, or a holiday. In such event, BPS may elect to postpone pool and spa service.
   
   In the event of inclement weather on the scheduled date of service, the pool and spa will be cleaned to the extent weather permits and only basic maintenance chemicals will be added.
   
   Customer must ensure BPS has access to the service area on the scheduled service day, including: gate entry codes, lock combinations, security guard verification, and pets relocated from pool/spa area. If BPS is unable to access the service area for any reason, services will not be performed that week and Customer shall not be entitled to a credit. In some cases, the customer may be charged a fee for failure to provide access on the scheduled date.
   
   Vacation/Holidays: BPS maintenance department may be closed and service will not be provided as follows: 1) Victoria Day 2) Canada Day, 3) Civic Holiday, 4) Labour Day, 5) Thanksgiving . If your existing service date falls on any of the Holidays noted above, your call may be rescheduled for 1-2 days following that date. In the event of an emergency, BPS will make every effort to return your calls and answer emails. Emergency services are provided at a separate agreed upon rate quoted on a case by case basis.
   
   
2. Services: BPS shall provide the following services each week (Not all items are applicable for each visit):
• Pool vacuumed as needed (if part of your selected package)
• Pool surface skimmed as needed
• Pool walls, floor, and tile to be brushed as needed
• Filter backwashed as needed or pressure on cartridge filter checked
• Skimmer & pump baskets emptied and cleaned out
• Brush/clean scum line, skimmer lid, skimmer and stairs (or ladder steps)
• Check/empty pool cleaner (if applicable)
• Pool-side water testing
• Chemical application as required according to pool-side test
• Pool equipment observed and issues are reported to service department
• Water sample collected at each visit and tested in-store at our water lab
• General tidy of the pool area and of any garbage left from our call
• Report of the call will be provided to you via hard-copy report or by email (customer preference)
  
  The CUSTOMER is responsible for water levels during the time in between visits. Recommended water level is MID-SKIMMER. Cartridge Filter cleaning is NOT included as a monthly service. One (1) mid-season cleaning of cartridges will be provided, unless extra service is required. Filters MUST be properly maintained for BPS to perform proper maintenance service. All standard maintenance visits are included in the contract price, and any additional or extra visits will be billed at a per call rate of $89 or $99 (depending on your package selection) + HST. If the pool is not maintained during the time between visits and extra time is required to clean & maintain the pool, extra clean-up charges may apply at $109/hour plus chemicals.
  
  
3. Repairs: Repairs are not included in the monthly service fee. BPS has a minimum charge of $89 for all service calls under a half hour (or 30 minutes). No exceptions for non-warranty calls. Flat fee install charges include labour, plumbing parts (ball valves and unions not included and are billed separately), and up to 5 linear ft of PVC flex or rigid pipe. The flat-fee for installation is $249 + HST. Other materials, unless otherwise stated, are extra and will be added to the invoice.
   
   
4. Pricing: Customer agrees to pay BPS the outlined package pricing in addition to monthly billing as stated above as well as any additional costs that may be incurred for repairs or services that are beyond the services specified in paragraph 2 above.
   
   
5. Payment: BPS requires a valid credit card on file for the duration of the pool season; some exceptions may apply. Each monthly payment will be processed by BPS in full when finalized after the last visit of each month. BPS will process installment payments on or around the payment scheduled outlined in paragraph 1. For example, the monthly payment for June may be processed prior to the end of the month (if your last visit falls before the month’s end) or during the next month once billing is finalized. If the card on file does not cover payment of the installment or monthly amounts, the Customer shall be in default. In the event of default, services may be postponed. Credit Cards will be left on file and payments automatically processed each month.
   
   
6. Card On File: ALL credit card information will be kept on file and held for use by BPS only. By providing this information and your signature below, Customer is authorizing BPS to charge the Card on File for all services provided to Customer by BPS pursuant to this Pool Service Agreement. Due to security purposes, cards may need to be updated from time to time.
   
   
7. Disclaimer: BPS shall not be responsible for any damage to property due to acts of nature, fire, vandalism, misuse, or abuse. Customer should be aware of normal deterioration of equipment that occurs over time due to regular use, exposure to chemicals, sunlight, and, in some cases, other corrosive materials (i.e. salt). The CUSTOMER is responsible for always maintaining the correct water level. BPS is not responsible for any damages or deterioration caused by failure of a Customer to perform other services recommended by BPS, or by failure of Customer to properly maintain pool and equipment between visits.
   
   
8. Termination: The Parties agree that this Agreement is a seasonal service agreement that continues from month to month until the end of the pool/spa season. The Agreement may be terminated by either Party. The customer accepts all charges up to the date of termination unless other terms have been agreed upon. Termination should be made in written notice delivered in person, by email, or at the offices of BPS.
